Web Scraping is Lawful, Though Being Prone to Myths
CIO Review Europe | Thursday, January 12, 2023
Many organisations use web scraping to drive business decisions and competitor pricing; legal concerns have taken the top spot, showing more still needs to be done to educate businesses on the practice.
FREMONT, CA: According to research, more work has to be done to educate organisations about web scraping. Due to complexity and regulatory issues, it is estimated that more than half of organisations have not used web scraping. While many organisations use online scraping to inform business decisions and competition pricing, legal issues have risen to the top of the list, Censuswide, indicating that more needs to be done to inform businesses about the technique.
This new study illustrates how companies utilise the more advanced technology to outperform their rivals. It surveyed over 1000 key decision makers in the UK and the US, including CTOs, VPs of Engineering, Chief Data Officers, Heads of Business Intelligence, and Heads of Data & Analytics.

Potential legal issues have been the main worry of companies that have not adopted web scraping. Legal risks are the primary justification given by more than half (53.06 per cent) of all organisations that haven't adopted web scraping.
Budgetary constraints are the second most commonly mentioned reason (39.59 per cent), closely followed by a lack of technical skills (30.20 per cent). Web scraping is now more accessible than ever because only one in five firms (20.82 per cent) give difficult technology as a reason not to employ it. Web scraping is still not well understood, and retailers should be aware of the enormous advantages it provides, particularly during the golden quarter.Iit has been challenging to dispel the notion that there is a legal danger associated with every data point, especially when it comes to online scraping. Even while businesses should always seek legal advice, there are industry best practices that, when followed, lower the majority of dangers related to data gathering. These findings show that we must work harder to inform the industry about the legal ramifications of web scraping.
Initiatives like the Ethical Web Data Collection Initiative (EWDCI), which aims to reach out to businesses and educate them on the importance of ethical data collection, as well as educate users and legislators worldwide in the interest of informed, empowered action, can be used by organisations to assist in educating business leaders. This will promote industry-led stewardship of vital and extensively used technology to address present issues and set the sector up for success in the future.
Retailers may improve the customer experience via web scraping, which is crucial during the golden quarter. Businesses can increase profits while maintaining their competitiveness and client loyalty. Scraping data on products and markets can help to fine-tune customer satisfaction initiatives through applications like recommendation engines. This data helps you develop a dynamic pricing plan to keep up with the changes and help maximise the profit because it also enables you to maintain a close eye on the generally changing market.
Lack of technical competence is a bigger obstacle for US-based businesses (46.77 per cent vs 37.16 per cent), but UK businesses are more affected by budgetary restrictions (32.24 per cent vs 24.19 per cent). The greatest factor for both locations, with essentially no differences (>50 per cent for both), is the likelihood of legal difficulties.
There are still many misconceptions about the web scraping sector, and organisations need to be better educated on this problem.
Web scraping is an effective tool for analysing webpages, and its advantages exceed its disadvantages by a wide margin. By analysing publicly available web data, retailers can gain insights into how to boost traffic and sales, manifest ideal conversation rates, and, in the end, save their businesses and give them a new and refined appearance.
